Enterprise comparison finds Copilot and Kiro indemnify generated code, while Cognition's Devin terms exclude outputs.
MarkTechPost compared enterprise contract terms for GitHub Copilot, AWS Kiro, Cursor, and Cognition's Devin and Devin Desktop (formerly Windsurf), checked against vendor pages on September 26, 2026. Copilot Business and Enterprise offer uncapped IP indemnification for unmodified outputs, and paid Kiro tiers offer uncapped copyright indemnity on output. Cursor's August 13, 2026 MSA defends claims that Suggestions infringe third-party IP and carves indemnity out of its fee cap, while Cognition's MSA treats outputs as Customer Data, excludes them from indemnity, and caps liability at twice prior-year fees. Residency also differs: Copilot can pin inference to the United States or European Union, Kiro stores content in the configured region, and Cursor offers no customer-selectable processing region.
